| T_SOURCE | 0 | ABSTRACT | The object of this Directive, drawn up pursuant to Article 2 (2) of Directive 75/442/EEC, is to approximate the laws of the Member States on the controlled management of hazardous waste. Member States ensure that hazardous waste is recorded and identified; they also ensure that different categories of hazardous waste are not mixed and that hazardous waste is not mixed with non-hazardous waste. Any establishment or undertaking which carries out disposal or recovery operations must obtain a permit. The permit requirement may be waived if the method of recovery is such that there is no danger to human health or the environment, or if the Member State has adopted general measures laying down conditions for various methods of recovery. Article 8(3) of Directive 91/689/EEC is deleted by the E-PRTR regulation (Regulation (EC) No 166/2006 of the European Parliament and of the Council of 18 January 2006 concerning the establishment of a European Pollutant Release and Transfer Register and amending Council Directives 91/689/EEC and 96/61/EC)CELEX No 32006R0166. Commission Decision 97/622/EC of 27 May 1997 concerning questionnaires for Member States reports on the implementation of certain Directives in the waste sector (implementation of Council Directive 91/692/EEC) (CELEX No 31997D0622) has to be used when reported on the implementation of the Hazardous Waste Directive. Commission Decision 97/622/EC is amended as regards to Hazardous Waste Directive by Commission Decision 2007/151/EC of 6 March 2007 amending Decisions 94/741/EC and 97/622/EC as regards the questionnaires for the report on the implementation of Directive 2006/12/EC of the European Parliament and of the Council on waste and on the implementation of Council Directive 91/689/EEC on hazardous waste (CELEX No 32007D0151) The Directive will be repealed from the Directive 2008/98/EC on waste with effect from 12/12/2010 | The Directive has been amended by Commission Directive 94/31/EC of 27 June 1994 (CELEX No 31994L0031).
